TERMS AND CONDITIONS OF SALE
I. General provisions
1.1. These Terms and Conditions of Sale (the “Terms”) are a binding legal document for the Customer and the Seller (together, the “Parties”). They set out the Parties’ rights and obligations, the conditions and procedures for purchasing, paying for, delivering and returning goods, and other provisions related to purchases made through www.mkojines.lt.
1.2. The Seller may amend these Terms at its discretion. The version in force when the Customer places an order applies to that order.
1.3. Purchases may be made by legally capable adults; persons aged 14–18 with the consent of a parent or guardian except where they may independently dispose of their income; legal entities; and authorised representatives of such persons.
1.4. A Customer may register and place an order only after becoming familiar with these Terms. By confirming agreement to the Terms and/or placing an order, the Customer confirms unconditional acceptance of them.
1.5. By accepting the Terms, the Customer agrees that personal data necessary for the sale and fulfilment of the order may be processed and that essential order-related information may be sent to the email address and telephone number provided.
1.6. The contract is considered concluded when the Customer forms a shopping cart, provides delivery information, selects a payment method, accepts the Terms and confirms the order, and the Seller subsequently confirms receipt of that order.
1.7. Contracts concluded between the Customer and the Seller are stored by www.mkojines.lt.
II. Privacy
2.1. The Customer may order goods either by registering on www.mkojines.lt and providing the personal data required to fulfil the order (name, surname, delivery address, telephone number and email address) or without registration.
2.2. www.mkojines.lt is not responsible for incorrect information entered by the Customer.
2.3. Personal data is used for order processing, delivery and, where legally permitted and consented to, direct marketing.
2.4. The Seller does not disclose personal information to third parties except service partners involved in delivery or fulfilment of the Customer’s order, or where disclosure is required by law.
2.5. Registered Customers must keep their login credentials secure and must not disclose them to third parties. The Seller is not liable for consequences arising from the Customer’s disclosure of login details.
2.6. A Customer who does not wish their email address and/or telephone number to be used for direct marketing may notify the Seller at mkojines@gmail.com.
III. Order procedure and conditions
3.1. The Customer has the right to purchase goods in accordance with these Terms and the information provided elsewhere in the online store.
3.2. The Customer selects goods while browsing the online store and adds them to the shopping cart.
3.3. After forming the cart, the Customer provides the information required for delivery, including name, surname, delivery address, telephone number and any additional information relevant to delivery, and confirms acceptance of the Terms.
3.4. The Customer selects a payment method and submits the order.
3.5. After confirmation, the order is sent to the Seller and the Customer receives an email confirming receipt. The contract is concluded when the Seller confirms the order. Unless cash on delivery in Vilnius has been selected, fulfilment begins after confirmation of payment is received.
3.6. Once payment is confirmed, the order status may be changed to “Paid”; this marks the start of order fulfilment.
3.7. Orders are stored in the Seller’s database for the period required by applicable Lithuanian law.
3.8. By submitting an order, the Customer confirms that they have read and accept these Terms and the conditions stated with the order.
3.9. The contract may be concluded and performed in Lithuanian, English or Russian.
IV. Customer rights and obligations
4.1. Subject to applicable Lithuanian law and statutory exceptions, the Customer may withdraw from the distance purchase contract by notifying the Seller in writing within 14 days of delivery and identifying the goods and order number.
4.2. The right of withdrawal may be exercised only where the goods have not been damaged, materially altered or used beyond what is necessary to inspect them, except where different rules apply to defective goods.
4.3. The Customer must accept the ordered goods and pay the agreed price.
4.4. If registration or contact information changes, the Customer must update it promptly or notify the Seller using the contact details provided on the Website. The Seller is not responsible for delivery errors caused by late notification of changed details.
4.5. The Customer must not transfer login credentials to third parties and must immediately inform the Seller if those credentials are lost or compromised.
4.6. By using www.mkojines.lt, the Customer agrees to comply with these Terms and applicable Lithuanian law.
V. Seller rights and obligations
5.1. The Seller undertakes to provide the conditions necessary for the Customer to use the services of www.mkojines.lt properly.
5.2. If the Customer attempts to disrupt the stability or security of the online store or breaches their obligations, the Seller may restrict or suspend access and, in exceptional cases, cancel the Customer’s registration.
5.3. The Seller respects the Customer’s right to privacy regarding personal information provided to the online store.
5.4. The Seller undertakes to deliver the ordered goods to the address specified by the Customer.
VI. Ordering, prices, payment and deadlines
6.1. Orders may be placed on www.mkojines.lt 24 hours a day, 7 days a week.
6.2. The purchase contract becomes effective when the Customer confirms the order and the Seller confirms receipt by email.
6.3. Product prices are displayed in the currencies available on the Website according to the applicable settings or exchange rates.
6.4. Payment may be made by bank transfer. Where offered for delivery within Vilnius, cash payment to the courier may also be available.
6.5. The Customer must pay within 2 working days of order confirmation, or within 5 working days for orders delivered outside Lithuania. Preparation and the delivery period begin after payment is received, unless another payment method has been agreed.
VII. Delivery
7.1. The Customer must provide an accurate delivery address.
7.2. The Customer should accept the goods personally. If another person is to accept the goods at the specified address, the Customer should notify the Seller in writing using the contact details provided on the Website.
7.3. If goods are delivered to the address provided by the Customer and accepted there, the Customer may not make a claim solely because another person accepted them.
7.4. Goods are delivered by the Seller or an authorised delivery provider.
7.5. Delivery times are stated on the “Delivery and Payment” page. These times are indicative and may not apply where goods are temporarily unavailable. In exceptional circumstances beyond the Seller’s control, delivery may be delayed; the Seller will contact the Customer to agree revised arrangements.
7.6. The Seller is not responsible for delivery delays caused by the Customer or circumstances beyond the Seller’s reasonable control.
7.7. The Customer must promptly notify the Seller if a parcel arrives in damaged packaging, contains unordered goods or an incorrect quantity, or has another obvious delivery problem.
7.8. Visible packaging damage should be recorded on the courier’s or postal delivery document, or in a separate damage report, in the presence of the delivery representative.
VIII. Product quality and warranties
8.1. The principal characteristics of each product are provided in the relevant product description on www.mkojines.lt.
8.2. The Seller is not responsible for minor differences in colour, shape or appearance caused by the Customer’s display settings or device characteristics.
8.3. Product warranties apply where required by Lithuanian law.
8.4. Consumer disputes are handled in accordance with applicable Lithuanian and European Union law.
IX. Returns and exchanges
9.1. Defective goods are repaired, replaced or returned in accordance with applicable Lithuanian consumer-protection legislation and statutory exceptions to the right of withdrawal. Refunds are made to the payer’s bank account unless another lawful method is agreed.
9.2. Where the right of withdrawal applies, the Customer may notify the Seller within 14 days of delivery using the contact details on the Website, stating the product, order number and reason for return where required.
9.3. Returned goods should be in their original tidy packaging, undamaged, unused and with their commercial appearance and labels preserved, except where these conditions do not apply to defective goods. The complete product set and proof of purchase should be provided.
9.4. The Seller may refuse a return that does not meet the applicable return conditions, subject to mandatory consumer law.
9.5. If the Customer receives the wrong or defective product, the Seller will arrange for it to be returned and, where possible, replaced with an equivalent suitable product.
9.6. If replacement is not possible, the amount paid for the goods will be refunded in accordance with applicable law.
9.7. Unless the goods are defective or the law provides otherwise, the Customer bears the direct cost of returning the goods.
X. Liability of the Customer and Seller
10.1. The Customer is responsible for the accuracy of personal data provided. The Seller is not responsible for consequences caused by inaccurate information supplied by the Customer.
10.2. The Customer is responsible for actions carried out using their account on www.mkojines.lt.
10.3. A registered Customer is responsible for protecting login credentials. A person using the Customer’s credentials may be treated as acting through that Customer’s account.
10.4. The Seller is not liable for losses caused by the Customer’s failure to read these Terms where the Customer had a reasonable opportunity to do so.
10.5. Where the Website contains links to third-party websites, the Seller is not responsible for their content or activities and does not control or represent those third parties.
10.6. A Party responsible for causing direct loss must compensate the other Party to the extent required by law.
XI. Marketing and information
11.1. The Seller may run promotions in the online store.
11.2. The Seller may change or cancel promotional conditions prospectively, subject to applicable law.
11.3. The Seller sends notices using the contact details provided by the Customer.
11.4. The Customer sends notices and questions using the contact details listed in the “Contact” section of www.mkojines.lt.
11.5. The Seller is not responsible where the Customer does not receive informational or confirmation messages because of internet, email or mobile-network disruptions outside the Seller’s control.
XII. Final provisions
12.1. These Terms and Conditions of Sale are governed by the laws of the Republic of Lithuania.
12.2. Disputes arising from these Terms should first be resolved through negotiation. If agreement cannot be reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
